Circuit Court probationer jailed for failing to appear

David J. Ruth, 36 of Traverse City was arrested in Grand Traverse County Friday on a Leelanau County Circuit Court bench warrant.  Ruth failed to appear at a show cause hearing as directed to answer why he had not paid $2,198 in court ordered restitution.

He pleaded guilty to Using the Internet to Commit a Crime after being arrested in August 2011.  Ruth told Sheriff's deputies that he made a deal to beat up the boyfriend of a friend's ex-wife for $1200.  The potential victim told police that his girlfriend had learned that her ex-husband had hired someone to beat him up.  The woman showed her boyfriend Facebook pages where the conversation took place between her ex-husband and Ruth.  There were photos along with the chat between the two men.

When the victim saw a man approaching his business, he recognized him as the man on Facebook who was hired to beat him up.  The victim confronted the would-be assailant about the matter and Ruth turned and left.  The victim called 911 and Leelanau County deputies interviewed Ruth and the victim.

Ruth was originally charged with Assault to do Great Bodily Harm less than Murder and Conspiracy.  He pleaded guilty to the Internet crime in exchange for the original charges being dismissed.  He was sentenced to six months in the County jail on the 2 year Felony charge.

He remains held on $2,198 bond pending a Circuit Court hearing if no bond is posted.
